The Brokerage Commission & Securities Litigation Team at Wilentz, Goldman & Spitzer is a sub-team of the firm's Business Litigation Team.

Our Services

Although we engage in all aspects of business litigation, our team has a sub-concentration involving:

  • The protection of real estate brokers on their commissionable events
  • Representing investors in securities-related litigation
  • Representing various security brokers before the NASD and other public bodies
  • Representing a significant number of physicians, both before the Board of Medical Examiners and also in their involvement in partnerships and professional corporate split-ups
  • Condominium Law - see www.no-condo.com

At times, litigation is best resolved by way of mediation, arbitration or settlement.  Surprisingly, approximately 90 percent of all cases that go to mediation are resolved.  Approximately 95 percent of all cases that go to litigation are resolved without a trial.  However, in our  experience, the only way to obtain the best results for our clients is to be ready, willing and able to go to trial.  With that preparation at hand, together with the proper advice to our clients, we have been successful and economical for our clients.

In each of the past 10 years, our business litigation attorneys have collected in excess of $2 million per year for their real estate brokers.  In 2003, we collected in excess of $5 million, and we have experienced similar successes on behalf of investors when their stockbrokers have imprudently handled investments.  Of course, results may vary depending upon your particular facts and legal circumstances.

Valuation issues in company split-ups and damages are always a key factor in commercial litigation.  Our team is especially trained in that field, having at its head a once-practicing accountant.  We continue to research and train in the field of valuations to better communicate with the experts and to be able to cross examine adversarial experts to expose reality.

Our Attorneys

Led by a noted practitioner, the litigation skills of our team are high quality.  Drawing on other areas of the law firm's resources when needed, we apply a team approach to our representation so that the client will receive the ultimate attention and representation.  Because of our commercial experience, we also keep our sights on the "bottom line" as it relates to cost-effective litigation.
